Temporary Restraining Order against ICE
On October 16, 2025, Judge Sara L. Ellis of the Northern District Court of Illinois, Eastern Division, issued a Modified Temporary Restraining Order (TRO) in a case brought by the Chicago Headline Club and others against the Secretary of Homeland Security and related federal officials. The TRO temporarily restricts the actions of federal law enforcement agents in the Northern District of Illinois, particularly regarding interactions with journalists, protesters, and religious practitioners during public demonstrations.
The key terms of the Modified Temporary Restraining Order are as follows:
- Federal agents are prohibited from dispersing, arresting, threatening, or using force against journalists, except in situations where there is probable cause to believe the journalist has committed a crime. They are also barred from interfering with journalists' ability to report, unless such interference is necessary to prevent crime or harm.
- Crowd dispersal orders are limited and may only be issued in exigent circumstances as defined by DHS policy.
- Use of crowd control weapons (such as chemical agents, projectiles, and electronic control devices) is prohibited against journalists, protesters, or religious practitioners who do not pose an immediate threat.
- Specific restrictions are placed on targeting sensitive body areas and on the use of force and crowd control devices.
- Federal agents must provide warnings before deploying crowd control weapons when feasible.
- Non-violent protesters who comply with dispersal orders cannot be arrested without probable cause.
- Federal agents (except undercover personnel) must wear visible identification, and those conducting immigration enforcement with body-worn cameras must activate them during enforcement activity (with defined exceptions).
- The order requires widespread dissemination of its terms and the issuance of implementing guidance to all applicable personnel. Defendants must file policies issued to enforce the order with the Court.
The TRO remains in effect until November 6, 2025, pending further hearings.
